"We have worked with Alexander twice now and both experiences have been exceptional. He recently helped us apply for a family visa so my husband could stay in the UK. Once again, the process was easy and successful thanks to his expertise."

UK Family Visa Essential Summary

Who can apply?

If you’re planning to live with a family member in the UK for over 6 months, you require a family visa. Eligible relationships include:

  • Spouse or partner
  • Fiancé, fiancée, or proposed civil partner
  • Child
  • Parent
  • Relative offering long-term care

If you’re in the UK for less than 6 months, consider checking if a Standard Visitor visa or Marriage Visitor visa is more appropriate.

Switching and Extending Family Visas

  • Switching: If you initially entered the UK on another visa type, there may be an opportunity to switch to a family visa. This is applicable for those wishing to stay with a spouse, partner, child, or parent.
  • Extending: Those in the UK on a family visa can apply for an extension before the current visa expires. Before doing so, it’s crucial to understand the required amount of time needed to settle in the UK.

The Application Process

  1. Duration: For applicants outside the UK, decisions are typically made within 24 weeks. If you apply from within the UK using the standard service, the decision usually takes 8 weeks. If you use the priority service by paying an additional £500, the UKVI will process your application within six weeks.

  2. Super Priority Service: For an additional £1,000, applicants from within the UK can expedite the decision-making process and get decisions in one working day after a biometric appointment or even on the same day of this appointment.

  3. Complications: Decisions might be delayed if:

    • The income requirement isn’t met
    • Proof of English proficiency is lacking
    • An interview is required
    • Specified/mandatory documentation isn’t provided
    • There are past criminal convictions or other personal circumstances

Documentation and Information Required

A successful application necessitates a myriad of essential documents and information, including:

  • Personal details: Names, date of birth, passports, previous immigration applications, criminal convictions, national insurance numbers (if any), and parents’ details for applicants outside the UK.
  • Partner details: If you have a partner, their information, including previous relationships, financial support details, and proof of relationship, is required.
  • Children: Details about all children, even if they’re not part of the application, are essential.
  • Life outside the UK: Information about countries you’ve lived in, visited, and contacts therein.

Additional documents might be necessary based on specific situations, like sponsorship forms from family members in the UK.

Highlighted Review

Adis Tusku: “Alexander Boyd was the only solicitor that helped my family and me. After two unsuccessful attempts with different law firms, the application made by Alexander was successful. I brought my mother to Scotland, and my father has a two-year permit visa. I strongly recommend Alexander Boyd for any immigration issue.“
