What your fixed fee does and doesn't cover

The advertised fixed fee is per person and covers the standard legal work specifically described in this package. It does not include third-party costs, translations, interpreters, expert reports, counsel/advocate/barrister fees or substantial additional work outside the agreed scope unless expressly stated.

Additional work arising after submission, including correspondence or complaints concerning Home Office delays, is not automatically included in the fixed fee. We may undertake such work without additional charge at our discretion, but where substantial additional work is required a separate fee may apply.

Expert Representation to Secure Your Release

Being held in immigration detention is one of the most frightening experiences you can face. You may feel isolated, confused about your rights, and uncertain whether you will ever be released. Alexander Boyd Solicitors are here to fight for you. Our specialist immigration bail solicitors provide expert, compassionate representation to secure your release from detention as quickly as possible.

Immigration bail application and representation from £999. Transparent fixed-fee pricing, agreed before you start. The fee is per person.

What Is Immigration Bail?

Immigration bail is a legal mechanism that allows a person held in immigration detention to be released and remain physically present in the UK while their immigration case is resolved. Being granted bail does not mean you have formally entered the UK under immigration law, but it does mean you can live in the community — often with your family — rather than remain detained, sometimes for months or years.

Bail can be granted by the Home Office directly or by the First-tier Tribunal (Immigration and Asylum Chamber). Our solicitors will identify the fastest and strongest route to your release.

Do You Have a Right to Immigration Bail?

Yes. The immigration authorities have a legal duty to consider granting you bail. Crucially, the burden falls on them to justify keeping you detained — not on you to justify your release. The law presumes in favour of release, and detention must be used sparingly, for the shortest period necessary, and only where there are no reasonable alternatives.

You may be in detention for one of the following reasons:

  • You are awaiting removal from the UK or the outcome of a Detained Appeals process
  • The Home Office is attempting to establish your identity
  • There are concerns you will not comply with conditions attached to your release
  • You have previously breached bail conditions, absconded, or failed to comply with immigration requirements
  • You have previously used deception in your dealings with the Home Office
  • You have no close ties — family, friends, or accommodation — in the UK

Even if one or more of these reasons applies to your situation, you may still be entitled to bail. Our immigration solicitors will carefully assess your circumstances and build the strongest possible case for your release.

Who Cannot Be Held in Immigration Detention?

Certain categories of people should not be detained except in genuinely exceptional circumstances. If you fall into any of the following groups, you have strong grounds for immediate release — and may also be entitled to compensation for any period of unlawful detention:

  • Unaccompanied children and young persons under 18
  • Elderly individuals
  • Pregnant women
  • People with serious medical conditions that cannot be adequately managed in detention
  • Those suffering from serious mental illness
  • Survivors of torture or trafficking
  • People with serious disabilities
  • Other vulnerable individuals

If you believe you fall into one of these categories and are being held in an Immigration Removal Centre or prison, contact Alexander Boyd Solicitors immediately.

How Can Alexander Boyd Solicitors Help With Your Immigration Bail Application?

Our experienced immigration solicitors provide end-to-end support throughout the bail process. From the moment you instruct us, we get to work.

Reviewing Your Detention and Identifying Grounds for Release

We will carry out a thorough review of your detention and immigration history to identify every available ground for bail. We examine whether your detention is lawful, whether Home Office policy has been properly followed, and whether your human rights are being respected.

Preparing a Comprehensive Bail Application

A well-prepared bail application is critical. We will draft detailed submissions addressing the tribunal’s key concerns — including your ties to the UK, proposed accommodation, personal circumstances, and any vulnerabilities — giving you the best possible chance of release.

Arranging a Surety or Bail Address

The strength of your application is significantly improved if you can provide a suitable bail address and a surety — someone who agrees to be financially responsible if you breach your bail conditions. We will advise you on how to approach this and ensure your surety is properly prepared for the hearing.

Attending Your Bail Hearing

Our solicitors will attend your bail hearing and represent you in person before the First-tier Tribunal. We will present your case clearly and compellingly, challenge the Home Office’s grounds for continued detention, and advocate vigorously for your release.

What Happens at an Immigration Bail Hearing?

At your bail hearing, a judge from the First-tier Tribunal (Immigration and Asylum Chamber) will consider whether there are sufficient grounds to keep you detained or whether you should be released, usually subject to conditions.

The judge will consider factors including:

  • The length of time you have been detained
  • The likelihood of removal actually taking place
  • Your compliance history with immigration authorities
  • Your ties to the UK — family, employment, accommodation
  • Any vulnerabilities or compassionate circumstances
  • Whether a surety is available and suitable

Our solicitors will prepare you thoroughly and present every relevant factor to the tribunal clearly and persuasively.

What Are Bail Conditions?

If bail is granted, it will usually come with conditions. These commonly include:

  • Reporting regularly to a Home Office reporting centre
  • Residing at a specified address
  • Surrender of travel documents
  • Electronic monitoring (tagging) in some cases
  • Restrictions on employment

Breaching these conditions is serious and can result in re-detention. Our solicitors will advise you fully on your obligations so that you remain compliant throughout your case.

Can a Refused Bail Application Be Reconsidered?

Yes. If your previous bail application was refused, you are not without options. You may be able to make a fresh bail application if your circumstances have changed since the last hearing. A change in circumstances might include new evidence, a change in your family situation, a new proposed bail address, or deterioration in your health or wellbeing while detained.

Our solicitors will advise you honestly on whether your situation has changed sufficiently to justify a fresh application and will work with you to maximise your prospects of success second time around.

What Is the Detention Duty Advice Scheme?

If you are currently held in an Immigration Removal Centre and have not yet instructed a solicitor, you can request a 30-minute appointment with a duty solicitor through the Detention Duty Advice Scheme. Ask at the library or speak to a welfare officer to arrange this. Visiting firms operate on a rota basis, so different lawyers attend each week.

Please note that Alexander Boyd Solicitors operate exclusively on a private fee-paying basis. We do not offer legal aid funding. If you have spoken with a duty solicitor and wish to instruct a private firm to handle your bail application with dedicated, focused representation, we are ready to act for you immediately.

Immigration Bail Application and Representation: Fixed Fee £999

Our fixed fee of £999 covers legal representation for the work listed in the package, including preparation of your bail application and attendance at your bail hearing. The fee is agreed before you start, with dedicated, professional representation focused on seeking your release.

Frequently Asked Questions: Immigration Bail

How long does immigration bail last?

Immigration bail lasts until your immigration case is resolved — this could be weeks, months, or in some cases years. You remain on bail with conditions until you either regularise your immigration status, are removed from the UK, or the Home Office withdraws its case.

Can I work on immigration bail?

Whether you are permitted to work on immigration bail depends on the specific conditions attached to your bail. Your solicitor will confirm this clearly when advising you on your bail conditions.

What happens if I breach my bail conditions?

Breaching bail conditions can result in re-detention and will make it significantly harder to obtain bail again in future. You must take your bail conditions seriously. If you are struggling to comply, contact your solicitor immediately.

How quickly can a bail application be made?

Once you instruct us, we will move as quickly as possible. Bail hearings are typically listed within days to a couple of weeks. We will apply for the earliest available hearing date and prepare your application thoroughly in the meantime.

What if I am a vulnerable person in detention?

If you are pregnant, elderly, have a serious medical condition, a mental health condition, or are a survivor of torture or trafficking, you have particularly strong grounds for release. Contact us immediately — these cases require urgent attention.

Alexander Boyd Solicitors is regulated by the Solicitors Regulation Authority. Our immigration team provides specialist representation across all areas of immigration detention, bail, and removal.
