Further Leave to Remain (FLR): Expert Guide to FLR(M) and FLR(FP) Applications

Further Leave to Remain (FLR) is a crucial process for individuals looking to extend their stay in the UK. Whether you’re a partner, spouse, or parent on a family route, understanding the intricacies of FLR applications is essential. At Alexander Boyd Immigration Solicitors, we specialise in guiding clients through the complexities of FLR(M) and FLR(FP) applications, for both extensions and switches to family routes within the UK.

What is Further Leave to Remain?

Further Leave to Remain refers to the extension of permission to stay in the UK beyond the initial visa period. It’s a vital step for those who wish to continue their life in the UK, whether for family reasons or to progress towards settlement. FLR applications are typically made when your current visa is approaching its expiry date, allowing you to maintain your legal status in the country.

Types of Further Leave to Remain Applications

FLR(M): Family Route for Partners and Spouses

FLR(M) is designed for partners and spouses of:

  • British citizens
  • Persons settled in the UK (those with Indefinite Leave to Remain)
  • Persons with pre-settled status under the EU Settlement Scheme
  • Individuals with refugee status or humanitarian protection in the UK

Key points about FLR(M):

  • Grants a 30-month extension
  • Part of the 5-year route to settlement
  • Requires meeting specific eligibility criteria, including financial and English language requirements

FLR(FP): Family and Private Life Route

FLR(FP) caters to individuals applying based on:

  • Family life as a partner (10-year route)
  • Family life as a parent (5-year and 10-year routes)
  • Private life in the UK (10-year route)

This route is often used in cases involving human rights considerations or exceptional circumstances.

Key Differences Between FLR(M) and FLR(FP)

Understanding the distinctions between these two routes is crucial for a successful application:

  1. Eligibility Criteria:
    • FLR(M) has stricter requirements, including financial thresholds and relationship evidence.
    • FLR(FP) may be more flexible, considering human rights aspects and exceptional circumstances.
  2. Duration and Path to Settlement:
    • FLR(M) typically leads to settlement after 5 years.
    • FLR(FP) often involves a 10-year route to settlement, with some exceptions for parents.
  3. Application Focus:
    • FLR(M) centres on the relationship with a British or settled partner.
    • FLR(FP) encompasses broader family and private life considerations.

Essential Documentation for FLR Applications

For FLR(M):

  • Valid passport
  • Proof of relationship (marriage certificate, civil partnership certificate)
  • Evidence of cohabitation
  • Financial documents meeting the minimum income requirement
  • English language proficiency evidence
  • Proof of adequate accommodation

For FLR(FP):

  • Valid passport
  • Evidence of family life or private life in the UK
  • Documentation supporting your length of residence in the UK
  • Proof of relationships with family members in the UK
  • Any relevant human rights considerations

The Application Process: A Step-by-Step Guide

  1. Determine the Correct Route: Assess whether FLR(M) or FLR(FP) is appropriate for your situation.
  2. Gather Required Documents: Compile all necessary evidence and documentation.
  3. Complete the Online Application Form: Accurately fill out the relevant FLR form.
  4. Apply before your current visa/leave expiry date. The UKVI/Home Office recommend to apply before or within 28 days of your visa expiry date.
  5. Pay the Application Fee and Immigration Health Surcharge: Ensure all fees are paid correctly.
  6. Book and Attend a Biometrics Appointment: Provide fingerprints and a photograph.
  7. Submit Additional Documents: Upload or send any required supporting evidence.
  8. Await Decision: Processing times vary, but typically take up to 8 weeks for standard applications.
